Eligibility Criteria
To be patentable, an invention must meet the following conditions:
- Novelty: The invention made must be new and kept secret from the public worldwide prior to filing.
- Inventive Step: The proposal must include a contribution to the state of the art and be non-obvious to a person skilled in the field.
- Industrial Applicability: The invention must be practically possible, capable of being made or used in industry.
- Patentable Subject Matter: The invention should not be in the nature of things which are specifically excluded from patentability under Section 3 and 4 of the Indian Patents Act (e.g. scientific theories, abstract ideas, laws of nature).

- Declaration of inventorship (Form 5)
- Power of attorney (if filed through Lawfinity)

- Priority documents (for claiming priority under the Paris Convention)
- MSME/startup certificate (for fee benefits, if applicable)
- Proof of right to apply (assignment deed if applicable)
Steps for Patent Registration
- Consultation & Search: Lawfinity performs a pre-examination search for patentable subject matter and risks of existing patents.
- Drafting of Specification: Our team can draft a comprehensive patent specification (provisional/complete specification) with claims, drawings and abstract.
- Filing of Application: We file the patent application with the Indian Patent Office (IPO) and give the applicant an application number.
- Publication of Application: The application is published after 18 months unless an early publication request is filed.
- Request for Examination: Once that is done, typically within 48 months, Lawfinity assists in filing an RFE and then an examiner looks into the application.
- Reply to Examination Report: We draft appropriate Reply to FER (First Examination Report) and hearings (if any).
- Issuance of Patent: Provided the application meets all of the requirements, the IPO issues the patent and announces the patent number in the official journal.
